ABSTRACT:We combine prior research on ethical decision-making in organizations with a rational choice theory of corporate crime from criminology to develop a model of corporate offending that is tested with a sample of U.S. managers. Despite demands for increased sanctioning of corporate offenders, we find that the threat of legal action does not directly affect the likelihood of misconduct. Managers’ evaluations of the ethics of the act, measured using a multidimensional ethics scale, have a significant effect, as do outcome expectancies (...) that result from being associated with the misconduct but not facing formal sanctions. The threat of formal sanctions appears to operate indirectly, influencing ethical evaluations and outcome expectancies. Obedience to authority also affects illegal intentions, with managers reporting higher prospective offending when they are ordered to engage in misconduct by a supervisor. (shrink)

This paper reviews the current commitment of accounting academics to teaching accounting ethics. In the course of the review it assesses the recent initiative of the American Accounting Association; namely, Ethics in the Accounting Curriculum: Cases and Readings, 1994. This collection of cases has not been widely adopted despite an identified lack of case materials available to those teaching accounting ethics. The question becomes whether the lack of adoption suggests that accounting academics are not particularly interested in incorporating ethical issues (...) in the classroom or whether there are difficulties with the quality of the collection. The paper continues by examining the current state of research in accounting ethics and again asks what this tells us about commitment to teaching accounting ethics. While the conclusions of this examination are far from definitive, there are signs that all is not well with the accounting ethics discipline. (shrink)

The proliferation of multistakeholder initiatives (MSIs) over the past years has sparked an intense debate on the political role of corporations in the governance of global business conduct. To gain a better understanding of corporate political behavior in multistakeholder governance, this article investigates how firms construct a political identity when participating in MSIs. Based on an in-depth case study of the Accord on Fire and Building Safety in Bangladesh—an MSI established after the collapse of the Rana Plaza garment factory complex (...) in 2013 to improve working conditions in the Bangladeshi garment industry—we introduce the construct of a political CSR (corporate social responsibility) identity (PCSRI) and explore how firms construct their PCSRIs in MSIs. Employing a qualitative, inductive theory-building method, we analyze interviews and archival data to develop a framework that elucidates how companies construct their PCSRIs within a continuum ranging from conservative to progressive. We show that constructing a PCSRI involves enacting specific, yet interrelated, political strategies that are themselves shaped by several forces over time. This article contributes to the literature by providing a political perspective on organizational identity construction that extends the emerging integrative perspective in political corporate social responsibility (PCSR) research. We suggest that MSIs should be conceptualized as inherently political governance mechanisms that are driven by multidirectional and dynamic political processes of identity construction. Our study shows that corporate political engagement in MSIs is a more nuanced and complex phenomenon than presently theorized. (shrink)

This paper presents the novel and seemingly controversial philosophical theology of Patrick Masterson, who dares to connect metaphysics to phenomenology in the continental philosophy of religion. He boldly claims that God is Esse Subsistens, the self-subsistent unlimited act of existence that exists independently of any relation to human consciousness. The paper lays out the dialogue between Masterson’s Thomistic-inspired metaphysics and some of the major trends in the phenomenology of religion. Parallels between his project and Vatican I and Fides et Ratio (...) are added for philosophical theological context. He concludes that without a metaphysical qualification, the current philosophy remains locked in an immanent frame that prevents any credible and realistic presentation of God. (shrink)

In this article, we wish to consider relationships internal and external to the farm household, and how these enable and/or mitigate the adoption of better farm practices. We find that internally, members of the farm household (successors or spouses ‘marrying in’), can influence the future direction of agricultural practice in a positive way, that is more profitable and sustainable. It is not a straightforward process though. Interpersonal household relations play a role; status and standing within the family can impact on (...) how decisions about change are made. This relates to both people marrying in and the position of the successor in an inter-generational household. We found that the power of the farming peer group to influence change is underestimated. Our data shows that farming is an occupation subject to strong cultural norms regarding acceptable farming practice. Sometimes farm family decisions to change agricultural practice falter under the weight of sanctions and derision encountered when trying to make adjustments. This paper draws from two data sets in Germany and England. We conclude that understanding internal farm household interactions, and their external relations with farming peer groups is critical to supporting the future of agriculture. (shrink)

Philosophers typically rely on intuitions when providing a semantics for counterfactual conditionals. However, intuitions regarding counterfactual conditionals are notoriously shaky. The aim of this paper is to provide a principled account of the semantics of counterfactual conditionals. This principled account is provided by what I dub the Royal Rule, a deterministic analogue of the Principal Principle relating chance and credence. The Royal Rule says that an ideal doxastic agent’s initial grade of disbelief in a proposition \(A\) , given that the (...) counterfactual distance in a given context to the closest \(A\) -worlds equals \(n\) , and no further information that is not admissible in this context, should equal \(n\) . Under the two assumptions that the presuppositions of a given context are admissible in this context, and that the theory of deterministic alethic or metaphysical modality is admissible in any context, it follows that the counterfactual distance distribution in a given context has the structure of a ranking function. The basic conditional logic V is shown to be sound and complete with respect to the resulting rank-theoretic semantics of counterfactuals. (shrink)

Bernard Williams distinguishes moral incapacities – incapacities that are themselves an expression of the moral life – from mere psychological ones in terms of deliberation. Against Williams I claim there are examples of such moral incapacity where no possible deliberation is involved – that an agent's incapacity may be a primitive feature or fact about their life. However Michael Clark argues that my claim here leaves the distinction between moral and psychological incapacity unexplained, and that an adequate understanding of the (...) kind of examples I suggest must involve at least some implicit reference to deliberation. In this paper I attempt to meet Clark's objection and further clarify my account of primitive moral incapacities by considering an example from Mark Twain's Huckleberry Finn. What this example shows, I argue, is how our characterization of an agent's response as a moral incapacity turns not on the idea of deliberation but on the way certain primitive incapacities for action are connected to a larger pattern of response in an agent's life, a pattern of response that itself helps to constitute our conception of that agent's character and the moral life more generally. A new semantics for modal logic results when we take this way of speaking seriously. We need not treat necessary truths as truths in all possible worlds. Instead, we may treat them as preconditions for the existence of any world at all. Background: In Switzerland, non-medical right-to-die organisations such as Exit Deutsche Schweiz and Dignitas offer suicide assistance to members suffering from incurable diseases. Objectives: First, to determine whether differences exist between the members who received assistance in suicide from Exit Deutsche Schweiz and Dignitas. Second, to investigate whether the practices of Exit Deutsche Schweiz have changed since the 1990s. Methods: This study analysed all cases of assisted suicide facilitated by Exit Deutsche Schweiz (E) and Dignitas (D) between 2001 and 2004 and (...) investigated by the University of Zurich’s Institute of Legal Medicine (E: n = 147; D: n = 274, total: 421). Furthermore, data from the Exit Deutsche Schweiz study which investigated all cases of assisted suicide during the period 1990–2000 (n = 149) were compared with the data of the present study. Results: More women than men were assisted in both organisations (D: 64%; E: 65%). Dignitas provided more assistance to non-residents (D: 91%; E: 3%; p = 0.000), younger persons (mean age in years (SD): D: 64.5 (14.1); E: 76.6 (13.3); p = 0.001), and people suffering from fatal diseases such as multiple sclerosis and amyotrophic lateral sclerosis (D: 79%; E: 67%; p = 0.013). Lethal medications were more often taken orally in cases assisted by Dignitas (D: 91%; E: 76%; p = 0.000). The number of women and the proportion of older people suffering from non-fatal diseases among suicides assisted by Exit Deutsche Schweiz has increased since the 1990s (women: 52% to 65%, p = 0.031; mean age in years (SD): 69.3 (17.0) to 76.9 (13.3), p = 0.000), non-fatal diseases: 22% to 34%, p = 0.026). Conclusions: Weariness of life rather than a fatal or hopeless medical condition may be a more common reason for older members of Exit Deutsche Schweiz to commit suicide. The strong over-representation of women in both Exit Deutsche Schweiz and Dignitas suicides is an important phenomenon so far largely overlooked and in need of further study. (shrink)

We can enrich the explanation of how we should treat kid wrongdoers by recognizing that it matters who does the blaming and punishing. That we should think about who does the blaming and punishing is perhaps unsurprising, but it is nonetheless often underappreciated. Here, I offer two lessons about blame and punishment by thinking about who judges kids. First, the right account of moral and legal responsibility should allow that kids may rightly blame each other, and I argue that we (...) can best accommodate this by relativizing the threshold of competence needed for responsibility. Second, although each kid is an individual and, as a result, the implications of immaturity vary signifi- cantly from kid to kid, we should give kids a break as kids, that is, based on our categorizing them as kids. That we should and do categorize in that way reflects the nature of the criminal justice system as an institution and the nature of us as social beings. (shrink)

Medical decision making relies heavily on the notion of the quality of a person's life in providing a reason to utilize one therapy over another or to withhold certain therapies altogether. The concept of quality of life, however, lacks clear definition as well as consensus on its constitutive elements. ;Chapter one engages a basic controversy in the literature: whether 'quality of life' should be understood as a subjective concept, or whether objective "lists" can help us assess a person's quality of (...) life. Chapter two examines whether anthropological data might provide guidance. While it is often argued that anthropological data supports relativism, John Finnis argues that anthropological data supports universalism which, in turn, bolsters objectivist claims. I argue that anthropological data may plausibly be interpreted to support either subjective or objective accounts, and thus, does not settle our approach to quality of life. ;Chapter Three examines objective list theories, in particular those of Bernard Gert and John Finnis. I find Gert's account to be problematic because it seems incomplete. Finnis's criteria, too, seems ultimately indefensible. Thus, I conclude that while objectivist claims may offer insight into human values and motivations, existing accounts are flawed. Chapter Four examines subjective accounts of quality of life. I focus on "preference satisfaction" accounts. While these accounts provide intuitively plausible descriptions, they fall victim to a host of difficulties. Perhaps the best example of this is the "fleeting preferences" problem, which undermines our confidence in making life-and-death decisions on the basis of quality of life considerations. ;The concluding chapter offers that much progress can be made by understanding quality of life in terms of finding meaning in life. Thus, the quality of one's life is determined by how much purpose and meaning is found in that life. While this notion is not without its problems, it does capture the complex elements of the kinds of cases in which we are particularly interested, and combines some of the best features of both the objective and subjective accounts. This is my commentary on Jonathan Schaffer's paper "Evidence for Fundamentality?”; both the paper and comments were presented at the Pacific APA, San Francisco, March 2001. Schaffer argues against the view that there is an ultimate fundamental level to the world. Seeing that quarks and leptons may have an infinite hierarchy of constituents, he claims, “empowers and dignifies the whole of nature” (15). Like Kant he holds that there are as good reasons for believing matter infinitely divisible as composed of (...) fundamental simples. I’m afraid that Schaffer’s provocative arguments have not convinced me. In the paper, I criticize the idea that fundamentalism 'weakens' and 'denigrates' the whole of nature and try to show that an infinite hierarchy can not do the work Schaffer needs it to. I then argue that we should not in fact be agnostic between the two rival hypotheses. (shrink)

I defend the hypothesis that organisms that produce and recognize meaningful utterances tend to use simpler procedures, and should use the simplest procedures, to produce and recognize those utterances. This should be a basic principle of any naturalist theory of meaning, which must begin with the recognition that the production and understanding of meanings is work. One measure of such work is the minimal amount of space resources that must go into storing a procedure to produce or recognize a meaningful (...) utterance. This cost has an objective measure, called Kolmogorov Complexity. I illustrate the use of this measure for a naturalist theory of meaning by showing how it offers a straight solution to one of the most influential arguments for meaning irrealism: the skeptical challenge posed by Kripke. Against a thinker like Martin Heidegger who takes restraints on individual freedom and the promotion of authoritarianism as implicit features in the ongoing development of technology, Andrew Feenberg argues for a “democratic rationalization” of modern technology whereby people effectively choose their own futures, not in spite of their tools, but increasingly because of them. Acknowledging the Web’s democratic potential, I believe that a new threat—far different from authoritarian regimes or structures—has emerged: a rampant and multifarious narcissism that threatens to drown (...) democratic ideals in a wave of self-obsession and self-promotion.
